Privacy Policy

1. Scope
This policy governs the handling of user information by Fixus LLC (the Company) in connection with the software "BackHook" (the Product), its associated website, and all incidental services (collectively, the Services). The Services include those currently offered as well as any services the Company may offer in the future.
2. Information collected
The Company may collect, to the extent necessary for the provision and operation of the Services, information including the following. The specific categories and methods of collection may be revised from time to time in line with changes to the Services, their features, or their delivery model.
- Information that the user enters or submits in the course of using, configuring, purchasing, or contacting the Services (including license keys, various settings, and the contents of inquiries directed to the Company)
- The license key, a device identifier generated from the user's device, and the source IP address accompanying license authentication communications
- Information about the user's device, OS, network environment, and other usage environment
- Information regarding the use of the Services, operation history, diagnostic information, and other usage analytics
- Information obtained through cookies, identifiers, log information, and other technical means
- Information lawfully received by the Company from payment processors or other third parties
3. Purposes of use
The Company uses the collected information to the extent necessary to achieve the following purposes, among others:
- Provision, operation, maintenance, support, and improvement of the Services
- License authentication and subscription management
- Notices, announcements, the provision of new features and services, and related communications relating to the Services
- Responses to inquiries from users, and the investigation and handling of issues
- Understanding, analysis, and statistical aggregation of usage of the Services and related business activities
- Responses to violations of terms, misuse, and other inappropriate use
- Planning, development, marketing, and related activities relating to the Company's business
- Other purposes incidental or related to the foregoing
4. Voice processing information flow
As a primary behavior of the current version of the Services, voice synthesis for the AI agent's spoken notifications to the user is completed locally on the user's own device and is not transmitted to the Company's servers. If the user enables the optional feature to use an external cloud voice provider (a third-party voice synthesis service that the user independently selects and registers), the text to be synthesized under that feature is sent to that third-party voice provider using an API key that the user manages. Such transmission and processing take place solely between the user and that third party; the handling thereof is governed by that third party's policies, and the Company is not involved.
The configuration of the information flow set out in this Article may be changed from time to time at the Company's discretion in light of changes to the features, delivery model, or applicable laws of the Services.
5. Communications for license authentication
To confirm that the Product is operating under a valid license, the license key and a device identifier generated from the user's device are transmitted, at startup and periodically, to the license authentication server of the Company's payment and license management provider (Lemon Squeezy). This communication is accompanied by the source IP address.
6. Provision to and entrustment with third parties
The Company may provide user information to, or entrust it with, third parties in any of the following cases:
- Provision of name, email address, payment information, and other necessary information to the payment processor (Lemon Squeezy) for purposes of payment processing and subscription management for the Services. Such payment processor handles such information as an independent data controller under its own privacy policy
- Provision or entrustment, in the form determined by the Company to be necessary, to business contractors, partner operators, affiliated companies, and other third parties, to the extent necessary to achieve the purposes of use
- Where the business is succeeded by reason of merger, business transfer, or other comparable event
- Where required by law, or in response to a lawful request from a public authority
- Where necessary for the protection of the life, body, or property of any person
- Other cases permitted by the Act on the Protection of Personal Information of Japan and related laws
7. Cookies and similar technologies
The Company may use cookies, identifiers, and other similar technologies for purposes including improving the convenience of the Services, understanding usage, conducting analytics, and improving the Services. The technologies used and their scope of use may be changed from time to time at the Company's discretion.
8. Information management
The Company implements measures it considers reasonable to prevent the leakage, loss, or damage of the information it collects, and otherwise to manage such information securely.
9. Retention period
The collected information is retained for the period necessary to achieve the purposes of use, or for such period as the Company deems necessary for its business, legal, or dispute-handling purposes.
10. Requests for disclosure and similar measures
Users may request, with respect to their own personal data held by the Company, disclosure, correction, addition, deletion, suspension of use, or suspension of provision to third parties (Disclosure Requests) under the Act on the Protection of Personal Information. The Company will respond, to a reasonable extent, after completing identity verification and other procedures designated by the Company. The Company may decline, in whole or in part, to respond to a Disclosure Request where any statutory exception applies, or where the Company reasonably determines that responding would cause material harm to the proper conduct of its business.
11. User responsibility
The user selects, registers, and operates third-party resources such as external cloud voice providers at the user's own discretion and responsibility, and any matters relating to the handling of information on, the safety management of, the billing for, the suspension of, and disputes concerning such third-party resources shall be resolved between the user and the providers of such resources. The Company assumes no responsibility for the handling of information on third-party resources selected by the user.
If, as a result of or in connection with the user's use of the Services, any damage, claim, demand, investigation, suit, fine, or other detriment is incurred by the Company, its officers, employees, contractors, partner operators, affiliated companies, or any third party, the user shall, at the user's own cost and responsibility, handle such matters and shall fully defend, indemnify, and hold harmless the Company and the foregoing parties.
12. Use by minors
Where minors use the Services, they shall do so with the consent of a parent, legal guardian, or other legal representative.
13. Geographic availability
The geographic availability and territories in which the Services may be used are subject to change from time to time at the Company's discretion. Users shall confirm at their own responsibility the lawfulness of using the Services in their respective locations and environments.
14. Changes to this policy
The Company may change this policy from time to time at its discretion in response to changes in the contents, features, or delivery model of the Services, in applicable laws, in social conditions, or in other circumstances. The amended policy takes effect at the moment the Company publishes it on this page, and no individual notice to users shall be required. Users bear the responsibility, prior to using the Services, of confirming for themselves the most recent contents published on this page, and the user's continued use of the Services after such publication shall be deemed to constitute the user's consent to the amended policy.
15. Governing law and jurisdiction
This policy is governed by the laws of Japan. Any and all disputes arising in connection with this policy or the Services shall be subject to the exclusive jurisdiction, in the first instance, of the district court having jurisdiction over the location of the Company.
